Possession of sexually explicit material in Maine
With regard to child pornography, possession of sexually explicit material is intentionally or knowingly transporting, exhibiting, purchasing, possessing, or accessing with the intent to view any material known to depict someone under the age of 16 (excluding spouses) engaging in sexually explicit conduct.
This statute is covered under Maine criminal code Title 17-A §284.
This is a Class D (misdemeanor) crime in Maine unless the victim is under the age of 12 or the accused has been convicted of a similar crime in the past. In such cases, it may be prosecuted as a Class C (felony) crime.
In Maine, the age of the person in sexually explicit material is determined based on their age when the content was created, not when it was viewed or possessed.
