Offense: OUI & Criminal Speed
Mandatory Minimum Penalty: $500 fine, 90 day loss of license, 48 hours jail
Maximum Penalty: $2,000.00 fine, 364 days jail, 90 day loss of license on the OUI and $1,000.00 fine, 180 days jail on the Criminal Speed.
Summary: Client was on his motorcycle speeding through a southern Maine town when his speed and operation drew the attention of local law enforcement. Officer testified at the BMV hearing that client was “hanging onto the motorcycle as he accelerated and his head would snap back as if he was dozing off.” In addition, the officer testified that the client was exceeding the speed limit by 34 mph. Client was stopped and investigated for OUI. Ultimately, he was arrested and blew a .13% BrAC. Client was charged with OUI as a result.
Result: OUI was dismissed at court and client pled guilty to Driving to Endanger for a fine of $575 and a license suspension of 30 days. Client also admitted to speeding and was issued a traffic ticket for that charge for which a fine was imposed.
