Charge: Aggravated Criminal Mischief (class “C” felony)
Maximum Penalty: 5 years prison; $5,000.00 fine
Summary: Client was transported by ambulance due to severe alcohol intoxication. Client, who was heavily intoxicated and disoriented, became combative and ripped the IVs out of his arm and began destroying equipment in the ambulance. Damages were estimated to be in excess of $2,000.00.
Result: Through a long process of negotiations, we were able to get the DA to dismiss the felony criminal mischief charge in return for a deferred disposition on a misdemeanor criminal mischief charge (class “D” misdemeanor).
