Charges: OUI
Maximum Penalty: 364 days jail; 150 day loss of license; $2,000.00 fine
Summary: Client was stopped for swerving and speeding. Client admitted to the recent consumption of alcohol and as such, was given sobriety tests. Client failed those tests miserably and was arrested for OUI. Client blew a .12% BrAC.
Result: Client, a single parent, couldn’t afford an OUI conviction as it would mean that the client would be dragged back into court by the other spouse and and child custody would likely shift from the client to the spouse. DA was sympathetic to our argument and agreed to dismiss the OUI in return for a plea to Driving to Endanger and a fine of $575.00.
